A planning application for the development of 20 dwelling houses adjacent to the existing Sean Mhuilean development in Ballinode village has been refused by Monaghan County Council. The application by RPK Construction Ltd had been submitted in April 2020, with significant further information submitted to the planning authority on 30th April 2021. The application for the houses also included the provision of landscaped open space, new access roads, draining, street lighting and associated siteworks. 16 submissions were made on the application, as well as representations from Inland Fisheries Ireland.

There were 5 conditions of refusal: 

1. A Road Safety Audit has been submitted in accordance with Policy TP 8 of the Monaghan County Development Plan 2019-2025. Concerns identified at the proposed site entrance have not been satisfactorily addressed, particularly as regards the Stage 1/2 Road Safety Audit. The proposal is therefore deemed to be unacceptable as it would (i) endanger public safety by reason of traffic hazard, (ii) be contrary to the Monaghan County Development Plan 2019-2025, and (iii) be contrary to the proper planning and sustainable development of the area

2. Section 15.27 of the Monaghan County Development Plan 2019-2025 outlines the safety and convenience requirements for accesses onto public roads. As per Section 15.27, the applicant has failed to clearly demonstrate that the minimum visibility requirements can be achieved at the development entrance. The proposal is therefore deemed to be unacceptable as it would (i) endanger public safety by reason of traffic hazard, (ii) be contrary to the Monaghan County Development Plan 2019-2025, and (iii) be contrary to the proper planning and sustainable development of the area.

3.As per the information submitted, or lack thereof, an agricultural building within 100m of the development, which appears to be within third-party ownership, has not been conclusively accounted for as per the requirements of Policy (for dwellings within 100m of agricultural buildings) RHP 4 of the County Development Plan 2019-2025. Consequently, the development would, if permitted as proposed, be contrary to the Monaghan County Development Plan 2019-2025 and contrary to the proper planning and   sustainable development of the area.

4.Policy RDP 9 of the Monaghan County Development Plan 2019-2025 requires that quality public amenity/open space is provided within multi-unit residential developments. The main public open space area, located to the rear of the site where it is not conveniently accessible to all the houses and is insufficiently overlooked, is considered to be substandard and unacceptable. Accordingly, if permitted as proposed, the development would (i) materially conflict with the Monaghan County Development Plan 2019-2025 and (ii) be contrary to the proper planning and sustainable development of the area.

5. Substantial retaining structures are proposed to facilitate the significant site works/excavation. Detailed designs including a geotechnical report have not been submitted in support of said retaining structures. Accordingly, the satisfactory/appropriate nature of the design standard is unconfirmed and to permit the development as proposed would be contrary to the proper planning and sustainable development of the area.
